TERMS OF SERVICEVIDEO scrapbook DESIGNYou, the customer, grant full production and editorial control of all aspects of editing and creating the product to Reflections Video Works (hereafter referred to as "RVW"). RVW agrees to work with you to create a video scrapbook that meets your specifications. RVW agrees to make every provision possible to incorporate your suggestions and ideas into the video scrapbook. You are to make all design and editorial suggestions prior to shipment. After you have received the video scrapbook, changes can be made only if (1) RVW failed to meet the specifications given by you prior to shipment (2) names, dates, quotes are incorrect according to the order form filled out by you. Please make copies of any photos you submit at a photo center before sending. Please do not send us irreplaceable items. We cannot be responsible for items lost in the mail. Every possible attempt is made to include every photo you send to us. RVW does not however, attempt to guarantee any specific picture be included in the video scrapbook. Certain photographs, depending on their quality and visual appearance, are impossible to scan and/or include in the presentation. RVW reserves the right to eliminate photographs from the video scrapbook. We also reserve the right to crop, color correct, or restore any photograph used in the presentation to increase visual appearance. Specific colors may not appear to be the same on screen; therefore, RVW is not responsible for photographs that appear to be slightly darker or lighter than the original prints. However, all attempts will be made to produce accurate representation of each photo. You are responsible for numbering each photograph and for specifying the order in which they are to appear in the video scrapbook. This can be done by writing on the back or using "post-it" notes. RVW does not guarantee, but will make every attempt to place the photos in the exact order requested. RVW assumes the right to change the order requested by you (slight changes to help the "flow" of the video, etc.) If placement order is not specified, RVW will attempt to categorize the photos chronologically. In this case, RVW is not responsible for photos that appear in the incorrect order. RVW agrees to make every attempt possible to verify all information given by you in the online order form. It is your responsibility, however, to ensure that all information provided on the order form is correct prior to submission. In the event that the incorrect information is included in the video scrapbook as a result of incorrect information provided in the order form (e.g. misspellings, incorrect information, music, etc.), it is your financial responsibility to purchase an additional copy with the correct information and/or return the incorrect videos to RVW to be corrected and returned (standard shipping applies). PAYMENTFull payment is due within 14 days of submitting a Reflections Video Works order form, unless otherwise agreed upon with a RVW representative. Dates are reserved only when complete payment is received. Payments can be made by cash, check, money order, credit card, or PayPal payment. Any bank charges incurred due to returned checks will be charged to you along with a $40 insufficient funds fee. All personal checks must clear before delivery with no exceptions. With this in mind, customers must plan accordingly. All selections are final once customer has turned in completed order form (this includes all photograph/music/package selections, etc.) unless otherwise agreed upon with RVW. All photographs and music selections will be returned to the customer only after full payment has been received. Full payment must be received before the video scrapbook is delivered with no exceptions. COPYRIGHTThe Copyright of all video scrapbooks is retained by RVW. Reproduction by video or any other means is strictly prohibited. Original files remain the property of RVW and may be used for advertising, display, or any other appropriate purpose. In return, RVW agrees to use the same in good faith and in good taste. All music used in video scrapbooks is copyrighted material to which RVW does not hold copyrights. By submitting an order form and agreeing to RVW's terms of service, you attest that you have purchased and possess your own original copy of all music used in your video. EXTENUATING CIRCUMSTANCESThe due performance of this agreement is subject to alteration or cancellation by RVW owing to any cause beyond their control. RVW takes the utmost care in processing, designing, and transporting customers' video scrapbooks. Every care is taken in scanning, designing, and processing using professional equipment and materials. In the unlikely event of total technical failure, or any extenuating circumstances that prevent the video from being delivered on time, RVW's liability shall be limited to a full refund of all money paid for the event package. In the event that a video is damaged during the shipping process, RVW will ship a new video to you (at no additional cost) upon the return of the damaged video. SHIPPING and SCANNINGIn the event that shipping is necessary, a shipping/packaging fee of $15 (US residents) or $25 (outside the US) will be added to the video scrapbook price. If overnight shipping is required as a result of late payment by you or a last-minute order, an additional charge is $10 will be added, bringing the shipping total to $25 for US residents. Shipping insurance is optional but recommended. Any insurance requested will cost you only the actual charge of insurance. You may scan your own photos or request that RVW scan them. Digital photographs sent to RVW on CD will not be returned to the customer unless specifically requested and agreed upon with a RVW representative. CUSTOMER AGREEMENTIt is mutually agreed that the above-mentioned terms form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Reflections Video Works in writing.
